About the Cryptoassets edition
Authorised firms that communicate or approve promotions of qualifying cryptoassets, and registered cryptoasset businesses that rely on the Financial Promotion Order exemption for registered persons. Qualifying cryptoassets are restricted mass market investments under COBS 4.12A, so an authorised firm that communicates or approves a promotion needs the prescribed risk warning, no incentives and the direct offer conditions. A registered person (a cryptoasset business registered with the FCA under the Money Laundering Regulations) may communicate its own qualifying cryptoasset promotions under article 73ZA of the Financial Promotion Order, unless the exemption is removed by article 73ZA(2), which applies where it breaches a section 55L requirement or a section 137S direction. Principle 7 applies to its promotions (PRIN 3.1.1BR). Approving a promotion for an unauthorised person needs approver permission.
The FCA does not set a template for a promotions register. This pack is a practical structure built on FSMA s21, COBS 4 and FG24/1. Read the financial promotions guide or see the compliance monitoring master pack, which includes a financial promotions review.
